Less than a month after Kyle Busch‘s death, a new report says that his wife, Samantha Busch, is set to inherit his entire estate.

According to a report from TMZ published on Tuesday, June 16, a petition has been filed requesting to appoint a man named Clifton Homesley as administrator of Kyle’s estate. Attached to the filing was Kyle’s will, which leaves his assets to Samantha. The documents also stated that no wrongful death lawsuit is expected to be filed.

Kyle died on May 21 at the age of 41 after battling pneumonia that turned to sepsis. As In Touch previously reported, the day prior to his death, the NASCAR star had lost consciousness while inside a racing simulator.

He was rushed to a nearby hospital and his family released a statement saying he had been hospitalized with a “severe illness.” However, hours later, it was revealed that he had passed away.

“We are saddened and heartbroken to share the news of the passing of Kyle Busch, a two-time Cup champion and one of our sport’s greatest and fiercest drivers,” NASCAR wrote in a statement via X on May 21. “We extend our deepest condolences to the Busch family, Richard Childress Racing and the entire motorsports community.”

Samantha, 40, broke her silence via Instagram on her husband’s tragic passing a few days later, thanking those who had offered her and the couple’s two children – Brexton, 11, and Lennix, 4 – support.

“While our hearts are absolutely shattered, we have felt God’s presence and arms wrapped tightly around us through each and every one of you,” she continued.

Earlier this month, Samantha shared a photo of Brexton and Lennix back at the racetrack and revealed she had made Kyle a promise while he was in the hospital before his death.

“I promised him that I would do everything I could to help our children pursue their dreams no matter what. For Brexton, that dream is racing,” the mom of two wrote on June 10.

“It wasn’t a dream Kyle chose for him. It was something they shared. They spent countless hours talking about race cars, working together, dreaming together, and building a bond around something they both genuinely loved,” she added. “Racing is what lights Brexton up and as long as it’s the dream in his heart, I’ll be right there beside him, cheering him on every step of the way.”
